Compensation for a Workplace Paralysis Injury
When a paralysis injury occurs that disables a worker, the worker is likely entitled to benefits through workers’ compensation insurance. Nearly all workers in the state are covered under this insurance program.
Medical benefits are the most common type of benefit available and cover all of an injured worker’s necessary and reasonable medical care, including hospital stays, prescription medications, surgeries, and other treatments. In fact, even transportation costs to and from doctors’ appointments are reimbursed.
When a worker is paralyzed, and they are determined to be permanently and totally incapacitated (which is recognized by Code of Virginia Section 65.2-503 as loss of both hands, both feet, both legs, both arms or “injury for all practical purposes resulting in total paralysis”), they are entitled to compensation for total incapacity. Compensation for complete inability is paid at a rate of 66 ⅔ % of the worker’s average weekly wage prior to the incident, and never less than 25% of the average weekly wage of the Commonwealth, nor more than 100% of the average weekly wage of the Commonwealth. The weekly compensation amount is paid for the lifetime of the injured employee, with no limit on the total amount of compensation that can be recovered over time.
