Attorney Hoen Helps Injured Veteran Secure $6 Million Settlement

By Jan Hoen

Recovering from a catastrophic injury is a long and challenging process, and also an expensive one. That’s why it’s critical for injured people to receive the full compensation they are entitled to after an accident or injury. At Hampton Injury Law, PLC, our team understands this, and it’s why we work so hard to help injured people receive the compensation they deserve. Recently, that dedication helped us win a multi-million-dollar settlement for our client, one of Virginia’s largest personal injury settlements in 2022.

Victim’s Fall Leads to Paralysis, and Premises Liability Lawsuit

After a fall from a second-story structure in Hampton Roads, a 44-year-old veteran was left paralyzed. The victim was facing substantial medical bills and a long road to recovery involving extensive medical care in the future. Because this incident resulted from careless or negligent actions on the part of others, the victim knew they could seek compensation, but getting the full amount needed to cover their expenses seemed unlikely. But with help from skilled attorneys, including Jan Hoen of Hampton Injury Law, PLC, the victim was able to recover a $6 million settlement.

Many personal details of the case are being kept confidential to help protect the victim from further harm. But we can confirm that the case involved complex issues of liability that were highly technical. The defendants raised issues of contributory negligence and causation that the legal team worked diligently to overcome.

Attorney Hoen worked with colleagues John M. Cooper and Bailey L. Gifford of Cooper Hurley Injury Lawyers to seek an appropriate settlement through mediation. After weeks went by with no resolution, the legal team was fully prepared to take the case to trial to get a fair outcome for their client. The defendants eventually realized that the victim’s attorneys would not back down and agreed to a $6 million settlement less than one month before the trial was set to begin. According to published reports, this was the eighth-largest settlement in Virginia in 2022.

Why Getting Full Compensation for Injury Cases Matters

When a person suffers an injury due to the negligent or careless actions of others, they are entitled to compensation to help pay for medical care and other losses due to the accident. If the injury is severe, the cost of future medical care and accommodations can be surprisingly high. For example, an individual paralyzed in a car accident might need ongoing medical care, but they may also require new equipment or redesigned spaces in their home to accommodate a wheelchair and complete routine daily tasks. These needs should be considered when determining the true cost of an injury.

We Help Injured People Get the Resources Needed to Recover

All too often, insurance companies attempt to minimize their costs by pushing injured people to quickly accept settlements that are way too low. The amount being offered may seem like a lot at the time, and most people are anxious to settle their medical bills. But a skilled attorney can help you determine the full value of your claim and help you fight for the compensation you deserve.

If you or a loved one have been injured by the actions of another person or entity, Hampton Injury Law, PLC, may be able to help. Call our office today or send us a message online to discuss your case.
