Our client was a 42-year-old military veteran and former police officer who was rendered paraplegic from a fall through the railing of a second-story exterior stair system. Multiple defendants denied liability for the condition of the premises and the case issues were complex, requiring us to retain an engineering expert and associate local co-counsel in the trial venue. The issues of liability, affirmative defenses, and damages were vigorously contested both before and after filing suit. The case was finally resolved by several weeks of mediation shortly before jury trial date. Settlement required recovery from liability policy limits of two defendants with additional coverage contribution from an excess liability umbrella policy disclosed during discovery after suit filed.
